Right of withdrawal

If the Customer is a “Consumer”, as defined in article 3 of the Consumer Code, they are entitled to the rights set out in art. 52 et seq. of the Consumer Code, as amended by Legislative Decree no. 21 of 21/02/2014, and therefore the right to withdraw from the Purchase Contract (hereinafter the “Right of Withdrawal”) for any reason, without giving reasons and without any penalty.

Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Goods purchased.

To exercise the right of withdrawal, the Customer must send a notice of withdrawal within 14 (fourteen) days from the day on which the Customer or their delegate acquires physical possession of the purchased products by signing for them.

The Customer may use a simple statement or the Withdrawal Form available in the ‘Orders’ area. The means and contact details to which the notice of withdrawal should be sent: ordini@olimpiaceramicheartistiche.it

Pursuant to art. 59 of Legislative Decree no. 206 of 06/09/2005 (Consumer Code), the right of withdrawal does not apply to goods made to measure, personalized, or which by their nature cannot be returned, are liable to deteriorate rapidly or may be damaged. Where a product on sale falls under one of the cases of art. 59 described above, the Site will state this with the phrase “Right of withdrawal not applicable” on the product page, in the checkout pages and in the order confirmation emails. Customers are advised to always check for this wording.

Once the Right of Withdrawal has been duly exercised, the Customer will receive, at the email address provided during registration, all the instructions for returning the Products: the case number and the address to which the Products must be returned (or the contact details of a carrier with whom to arrange pickup).

Olimpia ceramiche artistiche di Boscatto Olimpia, Via Comunale Catena, 7/A, 80126, Napoli

Pursuant to art. 57 of the Consumer Code, the Products must be returned to the Seller without undue delay and in any case no later than 14 (fourteen) days from the date on which the Consumer communicated their decision to withdraw. The date on which the Seller receives the notice of withdrawal and the date on which the Product is accepted by the post office or collected by a carrier shall be binding.

If the Customer has exercised the Right of Withdrawal in accordance with these conditions, the Seller, pursuant to art. 56, paragraph 1 of the Consumer Code, will fully refund the amounts paid by the Customer at the time of purchase, including shipping costs. The refund will be made using the same payment method used by the Customer, without undue delay and in any case within 14 (fourteen) days from the day on which the Seller is informed of the consumer’s decision to withdraw from the contract pursuant to article 54. The Seller may withhold the refund until it has received the goods or until the Customer has provided proof of having sent back the goods, whichever occurs first.

The consumer will bear only the direct cost of returning the goods.

Where the goods, by their nature, cannot normally be returned by mail, the estimated maximum return cost by product type is indicated below:

– Non-bulky products, up to a maximum of 10kg: 50€

The returned goods must be in resalable condition, preferably in their original packaging and with all accessories included. Under the Consumer Code, the Customer is liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. In that case the Seller reserves the right to ask the user to reimburse the diminished value ascertained. Therefore, although not required by law, the Customer is encouraged to insure goods returned in the exercise of the Right of Withdrawal.

If payment for a product no longer available has already been made, Olimpia ceramiche artistiche di Boscatto Olimpia will refund the amount paid by the buyer, including shipping costs, within 10 (ten) days of notification that the Product is unavailable. The refund amount will be communicated by email and credited to the same payment method used for the purchase or by bank transfer.
